Why Now Is Different

Abstract

Three forces have converged that did not previously exist together: a crowded airspace, a contradictory legislative response, and a compressed information environment. None depends on what the objects turn out to be; together they leave less margin for getting the next response wrong.

Recurring Incidents, Repeating Failures

Reports of unidentified objects over military and civilian airspace go back decades, and so do the institutional struggles to explain them. What separates the present moment is not the objects but the conditions surrounding them. Three forces have converged that did not previously exist together: a crowded airspace, a contradictory legislative response, and a compressed information environment. None of the three depends on what the objects turn out to be. Together they leave less margin for getting the next response wrong.

The airspace is getting more crowded. Commercial and military drones, autonomous systems, and low-Earth-orbit satellite constellations mean more objects in the sky than existing systems were designed to track. More than one million drones were lawfully registered with the Federal Aviation Administration () by December 2024 [1]. The U.S. Army alone requested more than $400 million for counter-small-unmanned aircraft systems () systems in fiscal year 2025 [2]. The volume of potential anomalous events will increase whether the underlying phenomena are changing.

The legislative tempo of -oriented legislation is accelerating, yet its direction is increasingly contradictory. The proposed Unidentified Anomalous Phenomena () [3] would establish formal declassification processes and an independent review board with eminent-domain authority over recovered materials. The Safe Airspace for Americans Act addresses operational response authorities. New Jersey passed Assembly Bill A-5712 in January 2026, establishing a state-funded Center for the Study of Unidentified Aerial Phenomena with $2.5 million in research grants. Vermont introduced Act , proposing a state airspace safety task force and House Bill 5422 is advancing in Connecticut, proposing a similar task force structure. There are legislative infrastructures being built in the absence of adequate federal action. Meanwhile, at the federal level, House Bill H.R. 8197 would dissolve the All-domain Anomaly Resolution Office () entirely and prohibit creation of any future centralized UAP office, redistributing its functions across the Pentagon. State legislatures are building new capacity while Congress is considering dismantling it federally. The contradictory trajectories make the coordination problem worse with each session.

The online information environment has compressed decision timelines and is driving conflicting public narratives. A sighting that in 1997 took weeks to reach national awareness and months to necessitate an official response (the [4]) now saturates social media within hours. The 2024 New Jersey drone incursions generated a volume of public discourse within seventy-two hours that dwarfs the entire Project [5] case archive in scale. Decision-makers who once had weeks of quiet investigation before issuing public statements now face a choice between immediate communication and ceding the narrative to speculation. The media and entertainment industry compounds this: the Age of Disclosure documentary [6], featuring 34 senior government officials, reached mainstream audiences in 2025. The information environment will not slow down to wait for institutional readiness.

As said by Ryan Graves, a former Navy F/A-18F pilot who testified before Congress regarding his squadron’s UAP encounters in 2023 and now leads Americans for Safe Aerospace, “There is really no closed system that would actually allow us to respond in a manner that would prevent an adversary from causing harm.” Radar operators, pilots, intelligence analysts, and public affairs officers are, in most cases, doing their jobs competently within the systems they have been given; the unresolved volatility lies in the loose patchwork connecting those systems and, in the inability to have them align.

These pressures expose three failures that recur across incidents worldwide, including over restricted military airspace: our ability to detect, identify, and track unknown objects is inadequate; we lack the institutional capacity to communicate and coordinate across agencies; and we lack clarity over who holds the authority to respond. Left unaddressed, the same gaps that produce confusion today could fail to surface a genuine homeland-security threat tomorrow. The New Jersey events of late 2024 made all three visible at once.
